Terms of Service

These Terms of Service ("Terms") govern your use of MotionConvert (motionconvert.com), operated by Solvera, KvK 97843776, VAT NL005292567B81, Mijdrecht, the Netherlands ("we", "us", "our"). By accessing or using the service, you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. Definitions
- Service — the MotionConvert website, web application, and public API at motionconvert.com.
- User / you — any person who uses the Service, with or without an account.
- Account — a registered user profile created by signing up with an email address and password.
- Content — the projects, components, configurations and other inputs you create or save in the Service.
2. The Service
MotionConvert provides web-based calculation tools for motion engineering, including a drivetrain calculator, gear/pulley ratio finder, belt-length calculator, statusword/controlword decoder, and a unit converter. The Service is offered "as is", with free and paid (Pro / Expert) tiers, and may be updated, extended or modified over time.
3. Accounts
- You may create an Account using a valid email address. You are responsible for keeping your credentials secure and for all activity under your Account.
- You must provide accurate information and keep your contact email current so we can reach you about service or billing matters.
- You must be at least 16 years old to create an Account.
- You may delete your Account at any time by contacting info@motionconvert.com.
- If you hold a paid Account (Pro, Expert, Early Bird), you may receive occasional product-update emails about new MotionConvert tools, pages and articles — the soft opt-in under ePrivacy Article 13(2). Every such email contains a one-click unsubscribe link, and you can opt out at any time in account settings. Free-tier accounts are only sent these emails if you tick the optional opt-in checkbox at signup or in settings. Full detail is in the Privacy Policy §11.
4. Acceptable Use
You agree not to:
- use the Service for any unlawful, infringing, harmful or abusive purpose;
- circumvent or attempt to circumvent rate limits, tier limits, authentication, or other technical restrictions;
- scrape, mirror, or systematically extract data beyond what the public API allows under your tier;
- upload or submit content that is illegal, infringing, malicious, or that violates the rights of others;
- attempt to disrupt, overload, or impair the Service, other users, or the underlying infrastructure;
- resell, sublicense, or repackage the Service or its calculation outputs as a competing product without our written permission.
We may suspend or terminate Accounts that violate these rules, with or without notice depending on severity.
5. Subscriptions, Pricing and Payment
- The free tier is available without payment, subject to the rate limits and feature gates published on the pricing page.
- Paid tiers (Pro, Expert) are offered as monthly or yearly subscriptions, billed in advance via Stripe. Prices are shown in EUR and include VAT where applicable.
- Subscriptions automatically renew at the end of each billing period unless cancelled. You can cancel at any time through the Stripe Customer Portal linked from your account settings; cancellation takes effect at the end of the current paid period.
- If a payment fails we may retry the charge and, if it remains unpaid, downgrade your Account to the free tier.
- We do not store your card details. Payment data is handled by Stripe under their own terms.
6. Refunds and Right of Withdrawal
For consumers in the EU, you have a 14-day right of withdrawal when you first subscribe to a paid tier. By starting to use the paid features within that period you expressly request immediate performance of the digital service and acknowledge that you lose the right of withdrawal once the service has been fully provided. Outside of that statutory right, paid periods that have already started are non-refundable. If you believe you were charged in error, contact info@motionconvert.com and we will review the case in good faith.
7. Your Content
- You retain ownership of the Content you create or upload (projects, configurations, components, etc.).
- You grant us a limited, worldwide, royalty-free licence to host, store, process, transmit and display your Content solely as needed to operate the Service for you (for example: saving configurations, generating share links you create, and producing PDFs you request).
- You are responsible for ensuring you have the necessary rights to any Content you upload.
8. Our Intellectual Property
The Service, its source code, design, branding, documentation, calculation logic and database structure are owned by Solvera or its licensors and are protected by intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you. The free, public API may be used in accordance with its documented limits; this does not grant any licence to copy or reproduce the Service itself.
9. Engineering Disclaimer and Professional Use
MotionConvert is a decision-support tool for professional engineering use. The calculations, visualisations and outputs it produces are informational and are not a substitute for professional engineering judgement, qualified review, applicable standards or regulatory approval.
By using the Service you confirm that:
- you are using the Service in a professional engineering, educational or evaluative capacity, and not as a layperson relying on the outputs as final advice;
- you will independently verify every value, formula, datasheet figure, animation or recommendation before using it in any real design, prototype, controller, machine, product or production system;
- you understand that motion calculations involve assumptions, datasheet tolerances, environmental factors, safety margins and standards that the Service cannot fully account for.
You must not rely on MotionConvert outputs for safety-critical, life-critical, mission-critical, medical, transport, aerospace, nuclear, defence, or otherwise regulated applications without independent verification by a qualified engineer and any required certification. The Service is provided for engineering convenience only and is not certified or warranted for any such use.
10. No Warranties
The Service is provided "as is" and "as available", with all faults, and without warranties of any kind, whether express, implied, statutory or otherwise. To the maximum extent permitted by law we disclaim all warranties, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, reliability, availability, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any output is correct, complete, or suitable for your purpose.
11. Limitation of Liability
To the fullest extent permitted by Dutch and EU law:
- No indirect or consequential loss. We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, contracts, savings, goodwill, data, time, opportunity, production, or for damage to equipment, machinery, prototypes, products or third-party systems, however caused, even if we have been advised of the possibility of such loss.
- Free-tier and anonymous use is at your own risk. Where you use the Service without paying us a fee — including anonymous, free-tier and trial use, the public API on the free quota, public share links, and the Email Results feature — the Service is provided to you free of charge and we accept no liability whatsoever for any loss or damage arising out of or in connection with that use, except to the extent liability cannot lawfully be excluded.
- Paid-tier cap. For paid users, our total aggregate liability for all claims arising out of or in connection with the Service in any 12-month period is capped at the fees you actually paid us for the Service in the 12 months immediately preceding the event giving rise to the claim. If no fees were paid in that period, the cap is zero.
- Per-output disclaimer. We are specifically not liable for any loss or damage caused by reliance on a calculation result, animation, exported PDF, share link, API response, datasheet figure or recommendation produced by the Service, where the user has not independently verified the output as required by Section 9.
Mandatory-law carve-out. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Dutch or EU law, including liability for intent or gross negligence, death or personal injury caused by our negligence, or liability under the Dutch product-liability regime (Boek 6, Title 3, Section 3 of the Burgerlijk Wetboek). Where any clause in this Section 11 is found to be unenforceable, it will be reduced to the minimum extent necessary to be enforceable, and the remainder of the Section will continue in full force.
12. Indemnity
You agree to indemnify, defend and hold harmless Solvera, its owner, employees and contractors from and against any third-party claims, demands, proceedings, losses, damages, fines, costs and reasonable legal fees arising out of or in connection with: (a) your use of the Service or any output produced by it; (b) your incorporation of any output of the Service into your own designs, products, machines, software, advice or deliverables; (c) your breach of these Terms, including the verification obligations in Section 9; or (d) your violation of any law or third-party right. This indemnity does not apply to the extent the claim is caused by our intent or gross negligence, or to the extent the indemnity is prohibited by mandatory law.
13. Third-Party Services
The Service relies on third-party providers, including Stripe (payments), our SMTP/email provider (transactional email), DigitalOcean (hosting), and Let's Encrypt (TLS). Their own terms govern their services. We are not liable for outages, errors, or actions of these third parties.
14. Suspension and Termination
- You may stop using the Service or delete your Account at any time.
- We may suspend or terminate your Account or access to the Service if you breach these Terms, if your use threatens the security or integrity of the Service, or if we are required to do so by law.
- Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, liability limits, indemnity, governing law) will survive.
15. Privacy
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.
16. Changes to These Terms
We may update these Terms as the Service evolves. The latest version will always be published on this page with an updated "Last updated" date. Material changes will, where reasonably possible, be communicated to Account holders by email or in-app notice. Continued use of the Service after changes take effect means you accept the updated Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands. Any disputes arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of the Netherlands, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
